Terms of Service – Spacerun Cloud Gaming

THESE TERMS OF SERVICE (“TERMS OF SERVICE” OR “AGREEMENT”) GOVERN YOUR USE OF THE BOOSTEROID.COM WEBSITE AND/OR ANY OF THE SERVICES OFFERED BY BOOSTEROID GAMES S.R.L. (“BOOSTEROID”, “WE”, “OUR”, OR “US”) (COLLECTIVELY, THE “SERVICES”).

BY ACCESSING, USING, SUBSCRIBING, OR PURCHASING ANY OF THE SERVICES, YOU (“USER”, “YOU”, OR “YOUR”) AGREE TO BE BOUND BY THESE TERMS OF SERVICE. IF YOU DO NOT AGREE, YOU MAY NOT USE THE SERVICES.

IF YOU ARE ENTERING INTO THIS AGREEMENT ON BEHALF OF A COMPANY OR OTHER LEGAL ENTITY, YOU REPRESENT THAT YOU HAVE THE AUTHORITY TO BIND SUCH ENTITY. IF YOU DO NOT HAVE SUCH AUTHORITY OR DO NOT AGREE WITH THESE TERMS, YOU MUST NOT ACCEPT THIS AGREEMENT OR USE THE SERVICES.

Spacerun may update these Terms of Service from time to time. Any changes will be posted on our website or communicated via email prior to becoming effective. Your continued use of the Services after such changes constitutes your acceptance of the updated Terms. You can review the most current version at https://spacerun.app/terms.

A. Certain Definitions

“Account” means a registered user account required to access the Services.
“User” means any person who accesses or uses the Services, whether registered or not.
“Session” means a cloud-based virtual gaming instance streamed to the User through Spacerun’s platform.
“User Content” means all information, data, or content provided, uploaded, or streamed by You through the Services.
“Intellectual Property Rights” means all patent, copyright, trademark, trade secret, and other proprietary rights in existence now or in the future.
“Usage Data” means diagnostic, technical, and performance information generated by Your use of the Services.

B. Service Description and Beta Notice

The Services provide access to games and software streamed from remote servers (“Cloud Gaming”). Certain features of the Services may be released in beta and are offered “as is” for testing and feedback purposes. Beta features may contain bugs or errors and may change or be discontinued at any time.

By using beta Services, You acknowledge that such use is at Your own risk.

C. Account Registration

You must be 18 years or older to create an Account and use the Services.
If You are under 18, You must have verifiable parental or guardian consent to use the Services.
You must provide accurate and complete information during registration.
You are responsible for maintaining the confidentiality of Your Account credentials and for all activities under Your Account.
You agree not to share Your login credentials with others or allow multiple people to use a single Account.
Spacerun will not be liable for losses or damages arising from unauthorized Account use.

D. User Content and Data

You retain ownership of all User Content and personal data you submit. However, by using the Services, You grant Spacerun a limited, non-exclusive, worldwide, royalty-free license to store, transmit, and process such data solely for the purpose of providing and improving the Services.

You represent and warrant that You have all necessary rights to upload and use such data, and that its use does not infringe upon any third-party rights.

Spacerun may aggregate and anonymize usage data to analyze service performance, enhance quality, and improve our offerings. Aggregated data will not identify You personally.

E. License and Restrictions

Spacerun grants You a limited, personal, non-exclusive, non-transferable, and revocable license to access and use the Services in accordance with these Terms.

You agree that You will not:

Use the Services for any unlawful purpose.
Share, rent, lease, sublicense, or resell access to Your Account.
Attempt to interfere with or disrupt the integrity or performance of the Services.
Use any automated systems (e.g., bots or scrapers) to interact with the platform.
Attempt to bypass regional restrictions or access servers in unauthorized territories.
Upload or stream content that is illegal, harmful, or violates others’ rights.

F. Fees and Billing

The Services may include paid subscriptions or one-time fees.
Prices, billing periods, and features are listed at https://spacerun.app/pricing.

You agree to pay all applicable charges in advance.
Payments are handled securely through our payment processor (e.g., Stripe).
All fees are non-refundable, including for partial use or account termination.
You are responsible for all taxes, duties, and fees associated with your use of the Services.
Spacerun may suspend or terminate access in case of payment failure or delinquency.

G. Term and Termination

This Agreement remains in effect while You use the Services.

You may terminate Your Account at any time by contacting support@spacerun.app.
Spacerun may suspend or terminate Your access immediately if:

You breach any provision of this Agreement;
You fail to pay applicable fees;
We believe Your actions threaten the integrity, security, or reputation of the Services.

Upon termination, Your access rights will immediately cease. Spacerun may delete all related data and sessions associated with Your Account.

Sections I, J, K, and L will survive termination.

H. Modifications to the Services

Spacerun reserves the right to modify, suspend, or discontinue the Services (in whole or in part) at any time, with or without notice.
We shall not be liable to You or any third party for such modifications, provided they do not materially breach our contractual obligations.

I. Intellectual Property

Except for User Content, all materials, software, design, logos, graphics, and related technology forming part of the Services are owned or licensed by Spacerun and are protected by intellectual property laws.

You may not copy, distribute, modify, create derivative works, or publicly display any part of the Services without prior written consent from Spacerun.

You retain full ownership of Your personal content and gameplay data.

J. Indemnity

You agree to defend, indemnify, and hold harmless Spacerun, its affiliates, employees, agents, and licensors from any claims, damages, liabilities, or expenses (including attorney’s fees) arising from:

Your use of the Services;
Your violation of these Terms;
Any infringement of third-party rights resulting from Your use or content.

K. Disclaimer of Warranties

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE”.
BOOSTEROID DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT:

THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE;
ANY DEFECTS WILL BE CORRECTED;
THE SERVICES OR SERVERS ARE FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS.

Your use of the Services is at your sole risk.

L. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BOOSTEROID, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES ARISING FROM YOUR USE OF THE SERVICES.

BOOSTEROID’S TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO BOOSTEROID IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

M. Publicity

You agree that Spacerun may identify You as a customer or user in promotional materials, provided such use complies with Your branding guidelines and applicable law.

N. Cookies and Session Tracking

When You access Your Account, Spacerun uses a session cookie to maintain Your login state.
This cookie is essential for authentication and expires when You log out or close Your browser.

We do not use cookies for advertising or third-party tracking.
By using the Services, You consent to the use of essential cookies.

O. General Conditions

Compliance with Laws: You agree to comply with all applicable laws, including export control regulations.
Entire Agreement: These Terms, along with any linked policies, constitute the entire agreement between You and Spacerun.
No Waiver: Our failure to enforce any right or provision shall not constitute a waiver of that right.
Severability: If any provision is found unenforceable, the remaining terms remain in full effect.
Governing Law: This Agreement shall be governed by and construed in accordance with the laws of Romania and applicable EU regulations.
